What is whistleblower protection and what is its purpose?

In 2019, Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law (hereinafter also the “Directive”) was adopted at the European Union level. According to this Directive, effective and comprehensive protection of whistleblowers—that is, individuals who report illegal conduct in connection with their work—is an essential element in the fight against corruption and a component of a functioning rule of law. Whistleblowers not only save public and private funds, but can also contribute to protecting public health, saving lives, helping to prevent environmental disasters, and so on. Individual Member States have adopted their transposition laws in connection with the Directive.

Protection of Individuals and Personal Data

Regarding the protection of personal data, as well as the protection of the whistleblower and the reported individual, procedures follow applicable laws and internal regulations. When reporting a violation, the whistleblower has the right to confidentiality and further protection. The whistleblower must be identified.

How the Report Will Be Handled

Depending on the content of the report, the designated person will take appropriate action and, if possible, inform the reporter of the results of each report. Feedback on the results of the report is provided to the reporter within a reasonable timeframe for evaluating its content and taking appropriate action.
